Failing stat check?

Initially I wanted to approach this run-through differently with a character build that used the Jinxed trait. Lastly, I decided not to as I knew that I eventually could acquire it later on in form of a perk.
Well, once I hit level twenty one the opportunity seemed granted to me as I then encountered the Pariah dog.
Thing is, the canine won't join me anymore apparently because of my high luck count (ten). I know there's a luck check to be failed but is that even reasonable when the stat is maximized?

Ohhh and before you inform me...I am aware of the step luck drop the dog "curses" you with should it follow. Though I must confess that I've exploited the encounter before to raise the stat, meaning my character won't suffer any penalties.
 
Failing a check with a stat of 10 seems very unlikely. Two things of notice, though: a) getting Jinxed from the pariah dog is somewhat a bad idea unless you want a Luck of 1 and b) Per says in his guide that it's not known whether the Jinxed trait and special perk do the same thing - perhaps the Jinxed special perk is just a title and the real deal is your Luck being lowered to 1.

My character's luck won't actually drop to one since her luck is "bugged". It didn't get lowered but instead increased once she killed the dog a couple of times.
I'm unsure about the jinxed perk simply being a title perk. I remember from earlier games, that except from myself, other NPCs' critical failures were also affected when the dog was tagging along.

EDIT: Okay, finally got the cake and ate it too! Was sorta expensive though. Went to NCR and received the bad zeta scan, picked up the dog and lastly bought the gain luck perk. Problem solved.
