HEUR/APC (Cloud) virus in killaps unofficial patch

Hey, I was installing this patch, downloaded from killaps webiste, and avira detected the virus HEUR/APC (cloud). Is this a false positive? what could have caused it? Has it happened to anyone else?
 
Never had any virus warnings from killap's UP/RP with my ESET NOD32. One possible cause is the included sfall (ddraw.dll):

This is caused by the proactive defences side of the virus scanner noticing that fallout is displaying suspicious behaviour. Either turn behaviour analysis down or off, or add the fallout folder to its exclusion path. It's not a false positive as such, because sfall does indeed pull some stunts which would look suspicious to a virus scanner.
 
Well, when I installed the game from GOG it already had the ddraw file, and nothing happened
Edit: not that the antivirus would notice that everytime, but i installed the game like 4 different time because of reasons, and does that file even install if it is already there? From what I understand, the GOG version doesnt include any patches
