Herve Caen, now Interplay's Chief Executive Officer and Interim Chief Financial Officer, has filed a new report with the SEC. The section reproduced here is Herve's reason for not filing with the SEC on time.

State below in reasonable detail the reasons why the Form 10-K, 20-F, 11-K, 10-Q, N-SAR, or the transition report portion thereof, could not be filed within the prescribed time period. (Attach extra sheets if needed.)

The Registrant's Form 10-Q for the period ended June 30, 2004, could not be filed within the prescribed time period because certain information and data relating to and necessary for the accurate completion of the Registrant's financial statements and management's discussion and analysis of financial condition and results of operation could not be obtained by Registrant within such time period without unreasonable effort or expense.</blockquote>It would be interesting to see what Herve constitutes as "unreasonable effort or expense."

In early March, Texas Big Bird changed hands again to a Mopar fan from overseas, Hervé Caen, Hervé, who is a Mopar Owners Club in France (originally called the Barracuda Owners Club) has lived in the USA for close to 15 years and owns several other Mopars, including two 68 Barracuda fastbacks. One of which was properly built by one of Hervé's friend Dick Landy. The Frenchman's plan is to put the Landy's team to work once more to go thru Texas Big Bird and have it ready to go after the European championship in the very competitive Completion Eliminator category with an AA/A tag in 2005.
 
Now that is interesting.. Is he going to run that race team into the ground and run away when he has got all the money he can out of it as well?

It could be a different Herve though :)

we don't spend money like drunken sailors, and we don't expect to make any money racing. That being said, let me explain where we are coming from, and how we can scratch each other's backs.

It means that he can't quite use the "all that data is in storage" excuse anymore. If he files the report, then it proves he has access to company records, and therefore that would seriously fuck him over with the claims he's made to the labor board.

Have you worked for him? He is a lair and a cheat. I hold him personally responsible for the destruction of Interplay. Not a turn-down in the economy, a change in consumer spending, the growth issues regarding consoles, but his own lack of intelligence and unwillingness to look beyond his own arrogance.
