ASCAP Wants My Money... Can They Take It?

Aye, I took the videos down in the mean time until things can be squared up but I told him that as well and asked if he could provide any cases relevant to embedding.
 
simple, that link actually backs your site up.

that judgement gives those content providers to host the material for others to use. it in no way stipulates that 3rd parties are not allowed to stream from their services.

not to mention its a scanned image and not a text searchable document.


ask them why they are sending you documentation of lawsuits versus content hosts when you do not host any material but rather linking and embedding their content in your web pages.
 
Aye, you're reading it the same way I had. And yea, the non searchable thing really made it a pain reading it lol.

But from what I read in there, it sounds like they ruled for yahoo to allow usage of their videos if they pay... since they paid, I should be free to use it.

If he doesn't respond by mid next week, I'm just going to put the vids back up. Thanks for the thought Wes

It's part of the agreement that they can allow other sites to embed videos on their sites and there is an opt out feature on all video sites that disables embedding. You are not hosting the content nor are you intentionally distributing copyrighted material without consent (we went over that earlier) so if anyone is at fault, it's the host not you. What they ASCAP is trying to do is illegal and I again advise you to get in contact with consumer services and report their abuse. Getting consumer services involved will help greatly because they are harder to bully and have a better understanding of the law.
