Interplay has filed a form 8-K to officially notify everyone that they're in trouble. Having failed to file two consecutive 10-K's SEC is finally after them:<blockquote>On May 24, 2005, the Company received a letter from NASDAQ relating to a hearing regarding the eligibility of the Company's securities for quotation on the OTC Bulletin Board ("OTCBB") and providing formal notice of a telephonic hearing on June 2, 2005 when the Panel authorized by the NASD Board of Governors will determine whether the Company's securities are eligible for quotation on the OTCBB under the requirements of NASD Rules 6530 and 6540. The trading symbol for the Company's common stock on the OTCBB is currently "IPLYE", so that the Company's common stock will be ineligible for quotation and subject to removal from the OTCBB if the NASD does not receive information that the Company is current in its public reporting obligations pursuant to NASD Rules 6530 and 6540. The Company failed to file its 10-K for the period ended December 31, 2004 within the prescribed time period and thirty calendar day grace period and the Company failed to file its 10-Q for the period ended March 31, 2005 within the prescribed time period.</blockquote>On the Raging Bull Interplay forum, Rbusslinger notes that "the office is still there". Not much comfort if you consider the fact that there has been no news on servers from Ballerium since January and that the company working on its currently consists of two unpaid employees, meaning we can probably label the game "Vapourware" by now or at least worthless if it ever gets out.

Other than that, I can only say that if they finally die, then perhaps everyone still involved in the company can move on to something else, something where they will either do more good or less harm.

There isn't actually anyone left involved in the company, just some intellectual property, Herve (who's not a person) and the stockholdersd

Interplay somehow always manages to bump up with new, unique problems. While I won't report on their nt-10K filings anymore, their sales or, in this case, problems are still fun to look at.

They can't last much longer. THEY CAN'T. I suspect Herve uses black magic to keep the company afloat
 
Interplay also has an August 25 hearing regarding Herve's misdealings regarding wages, hours, salaries, and even accrued unspent (and unpaid after a full year) vacation hours.

His little trick he tried to pull is going to backfire on him. For those that don't know, I will explain . . .
Starting on April 15th, 2004, Herve was unable to meet payroll for both salary and hourly employees on time. By May 15th, he was one full pay period behind, and by the time the state locked the doors on June 15th for refusing to pay state workers compensation insurance, he was 3 periods behind (he never sent out notices of termination or lay off).

This is where it gets a little confusion so stay with me . . .
A few months later, long after the business was closed, its records gone or other, Herve claimed that all his employees had really been hourly, not salary, and thus he was only going to pay wages based on their time cards. For those of you who work as a salary employee, how many work in places where your hours are logged?? Interplay, like most places, did not keep track of the coming and goings of salary employees on an hourly basis.

California labor law does not allow an employer to change the work status of employee with out notification to the employee, and certainly not after a pay period has come and gone. Herve used this trick to save a few pennies and now he has to pay all those pennies back, plus penalties.

On a similar note, Herve, after a year, is still refusing to pay accrued and unspent vacation hours. According to California labor law those funds must be paid with 72 hours of the employee leaving (or less depending on how your employment ended). A Dave Berman has been acting as Interplay's front man regarding this, but after months and months of wrangleling, I have given up hope of him seeing that Interplay really does HAVE to pay vacation hours, now, not later.

Yes, you a may. As a former shareholder you have my express written (typed) blessings. I feel guilty. I actually sold my shares for a profit after BIS was closed. Perhaps I can attone vicariously through your acts.
