It's a chemical weapon that injures military and civilian personnel regardless. Therefore it fits that definition.
I'm not going to go looking for any other definitions to back my claim up, the WMD term is overused and meaningless nowadays anyway. If we'd wanted to be precise the term "area effect weapon" would probably be a better one. Sadly AEW sounds stupid and doesn't have much buzzword potential.
