Titus/Interplay Dead? [January 05, 2005, 12:56 pm EST] - 4 Comments
French site GameKult is reporting that a court decision has terminated the grace period under which bankrupt Titus Interactive was operating, forcing the liquidation of the troubled publisher, a move that also signals an end to operation of Titus subsidiary Interplay. The article is in French, so a run through Babel Fish can offer a rough translation. There is no uncertainty to the article, but no external source is provided for these reports of the demise of Titus, Interplay, as well as a couple of French subsidiaries, though the Raging Bull Investor Forum offers a French press release that also reports on the end of Titus. I guess, I'm never going to get my accrued vaction money that Herve still owes me.

I've allready written off the work hours when he pulled his little salary to wage stunt.

I sympathize, Corith. I would imagine that all of the employee's that Herve and company have screwed over the past year are following this with truly mixed emotions.
 
you are probably correct, corith. though, when the company i worked for went under, employees were paid first. however, in that case there were a couple differences 1) we were wholly an american company abiding by american laws only and 2) they didn't completely go under (the remaining people and IP were bought by InterDigital eventually).

of course, iply is american but titus is what's being liquidated under french law. i have no idea how they manage that bit. you may have some recourse, however, and will likely find out in the days to come...

i'm wondering, btw, how they handle this kind of thing in france. over here, there would be some sort of auction for remaining assets. part of the reason iply still held the jefferson engine is because (rumor) herve wanted too much money for it. however, he doesn't have any say now if it is auctioned off... a smaller company, such as obsidian or inxile (troika has its own engine so not much need), could easily pick up a completed engine to code some new games with...

euhm the reason why corith wont get paid is because there is virtually nothing to liquidate @ IPLY in the first place (thats including the jefferson engine)...

(even if the liquidation of titus and others raise some money, it will never flow towards IPLY)

First of all, the notion of corporate entities make it impossible to sue the people that work for them. Secondly, what for? You slipped on your fallout CD in the bathtub, or emotional abuse from cancellation of FO3? Forget $ just get me the FO2 source code :) Wouldn't it be sweet if that somehow got leaked.
 
I wouldnt be too suprised if Bethesda gobbled up all FO rights after this, though I hope Troika gets a peice of the pie..........

Maybe if Beth buys all FO material, theyll release it ? (or sell it with FO3 more likley, or maybe with oblivion just to make us buy it)
 
A big part of the problem, is that once he was evicted, Herve converted all employees to hourly, and used the excuse that there was no records of the comings and goings of those formerly salary employees.

Since the payrolls in question where several months back there was no way to dispute the hours in real time. With no place of business, there was nobody to complain too, nor was there even supervisors to verify employee presence. Nothing.

Basically, Herve (and Phil) used the lack of time cards for salary employees to avoid paying his employees past due wages.

He is also, or was, claiming that he has no records, including records regarding vacation disbursement. It is amazing that he had enough records to pay by the hour, huh?

Hahahah, yeah, right. Who are they going to go after? Herve is hiding in a cave in france. There is nobody but kelly temp and a janitor at Interplay's shadow offices.

I have my doubts I will even see W2 forms (USA income records for you non-usa vistors) .
 
First post here - as a fallout 1 & 2 fan I often check this site and these boards, but never posted before. So hello all !

Yes, this is what we also do here for a liquidation : there should be an auction to sell the remaining assets of Titus and its subsidiaries to reimburse part of the debt (other posters can confirm this).
Looks like they owe more than 130 millions dollars though, so the auction will probably cover little part of the debt.
 
Only two of their franchises have any current worth: Fallout and Baldur's Gate. Descent has been dead for, what, about 5 years? And they also published numerous games, like Sacrifice, that while not terrible never really took off. Everyone knows Bethesda payed around a million clams for FO, the bigger question is the status of BG3 that was supposedly being developed by someone. I suppose during the process of liquidation they sell off publishing rights to someone else...

Also a few years ago I think Interplay published a compilation of all the old gold box games... So their list of properties, dead or not, is quite extensive.

You mean to someone other that those who last bought them? Wouldn't that be like if I bought a tomato and then someone came home to me and said it's not my tomato any more because the tomato vendor is now bankrupt? 'Cause I would be all, like, hands off my tomato.
 
I think what that means if Bethesda still has exclusive rights to FO 3-4-5, but all MMO FO rights, and the lisence itslef past those 3 sequels is up for rights.

Last I talked to Phil Adam, Phill claimed that Herve hadn't been in the states for any real length of time since they (Interplay) moved out of Von Karman
