Fascism of RIAA

Apparently, being an immensely rich music industry conglomerate means you can randomly violate basic human rights. In addition to their usual breaches of people's privacy, RIAA also repeatedly demonstrated that Universal Declaration of Human Rights articles 17 ("No one shall be arbitrarily deprived of his property.") and 11 ("Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence."; "No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed.") mean nothing to them.

Namely, a man in Milwaukee was forced to refinance his house to cover a financial settlement (no, not a penalty - a fucking settlement!) of $11,000 with the Recording Industry Association of America, after the said association (or, should I say, crime syndicate) pressed charges against him on account of traces of MP3 songs (no, not actual songs - fucking traces!) they allegedly found on his computer. The question I must ask myself is - how the fuck did RIAA find these "traces", and what the fuck gives them right to arbitrarily scan people's hard drives?! Even if the said man did violate the copyright laws by possessing MP3s, how do traces of these MP3s constitute evidence that such violation occured, and, more importantly, how can such evidence, quite obviously obtained in a downright illegal manner, ever be used in the court to prove the charges against the Milwaukee gentleman? These RIAA fuckers should be the ones paying him $11,000 to settle what was obviously a rude breach of his privacy!

I simply can't describe how pissed I am at what these fucking dipshits are doing! What kind of a fucking world do we live in, when a criminal organization like RIAA can openly extort money from ordinary citizens without any repercussions whatsoever?! Fuck capitalism and fuck democracy - in the totalitarian socialism we were at least protected from neofascist motherfuckers who use their tremendous financial wealth and power that comes with it to terrorize helpless people without any sanctions from government organs that are supposed to protect these people's constitutional rights! When I have a job and am wealthy enough to buy CDs, there's no way in hell I'm buying a single song from these ruthless, money-grubbing shitfaces! I'd rather be stabbed in the kidneys than give a single penny to an organization that illegally spies on citizens and extorts money from them! As for intellectual property and copyright laws, they can fucking go to hell - why the fuck would I acknowledge and obey laws of a country that doesn't give a shit about the fact that a criminal syndicate oppresses its citizens?! To hell with them all! Disobey! Dissent! Rebel! Revolt!

I think almost all free countries has a law that states that evidence gathered through illegal activity is inadmissable. This sounds like such a case.

And another Reason why I like Independent-Bands without a Label (with MP3 downloads for free...)

EDIT: Grr.... just a stupic german native speaker could make the stupid mistake to write all noms with capital letters
I do not change it to show you how dumb I are...

Yet another reason why I love living in Canada, eh?
Yeah. Except for the lack of jobs, the lack of oppertunity, the overbearing beaurocracy and the total lack of attractive chicks, it's fine and dandy.
Except Quebec.

Don't be so hard on yourself. After all, you're German.. You're allowed to make mistakes.

Don't tell me you like Quebec CCR, unless your confusing syntax means that Quebec is not "find and dandy" while simultaneously lacking jobs, opportunity, and attractive checks.

Err... who said they scanned his hard-drive? They could be monitoring the IP addresses of people using P2P programs, and track him that way. Or other non-invasive remote surveillance.

Not to say the RIAA aren't bastards, but there are ways inside the law to accomplish this particular feat.

How friendly you are...

@Topic: I's the same problem with Microsoft.
The (not very got hided) spyware sends Infos about your system to Microsoft....
I'm happy that they're some laws of the european union that prohibit things like that.
So in Europe it's totaly useless for MS to try to get any money from you because you are using a copied msoffice

The same problem: Copyright is for some firms more worthful than privacy (and we can only hope that there's no judge thinking so)

Its stuff like that going on that makes me happy that as long as our lives become more dependent on technology that while it may make it easier to control us it is also easier to fight back. Take Microsoft for example. When was the last virus scare you remember that targeted Linux users?

The internet...the ultimate source for anything and everything often free of charge! Here's where small groups like us can go toe to toe with any more powerful entity. I mean I got here as quickly as I could access ESPN.com...

I mean dictatorial countries cant allow the net cause it will incite revolt...by keeping things like it banned it holds the advancement of their societys back.

Sincerely,
The Vault Dweller

I wouldn't have taken exception to this type of example if the viruses were targeting Microsoft specifically (not simply their products). But it destroys the property and documents of innocents. Its hard to romanticize the notion of anti-Windows hackers when they're destroying normal people's systems.

USA needs it´s big corporations in order to be successful . . so they can bend a law here and there, so what if some human rights get broken

Nobody's rights are being deprived. The RIAA has simply bullied a fellow into giving them money instead of going through a lengthy and defacing lawsuit.

"I'm giving up and can't fight this," said Ross Plank, 36, of Playa Del Ray, Calif. He had professed his innocence but surrendered after lawyers found on his computer traces of hundreds of songs that had been deleted one day after he was sued.

Interesting to note, yes?

Ratty also failed to mention the RIAA cases that have been overturned by judges, which were cited in the very article.

Lots of DC++ hubs have the following as a header:
By Joining This Direct Connect Hub, you agree that you
are not in any way affiliated with any government,
police, ANTI-Piracy Group, RIAA, MPAA, or any other
related group. If you are in any way affiliated with
any of these groups, you CANNOT enter this channel. By
Entering you are as a member of one or more of these
groups, you are not agreeing to these terms and you are
violating code 431.322.12 ::of the Internet Privacy Act
signed by President Bill Clinton in 1995, and you may
not threaten or Prosecute anyone in this channel

thereby making it illegal for the RIAA to go into ANY of them.

most torrent sites and irc networks that support downloads have more or less the same disclaimer. however i'm not certain thats enough to ward off any legal action. anyhow, doesnt concern me anyway, i'm not a resident of the US.

the belgian computer crimes shiznit has their hands full with more important stuff. there is only "Brein" and "Sabam" to screw us in the ass, and they dont have that much power and resources anyway. all ISPs also protect their users, unlike what i've seen in the US. here most ISPs issue a warning before they give up your information to such groups when they are pressured to reveal your info.

thereby making it illegal for the RIAA to go into ANY of them.
That is why my friend didn't panic, he wrote them back saying that even if they know he did it they can't do anything about it. Other poor saps on the other hand can be bullied around, so those RIAA miscreants just hunt the easy prey. What happened to "Fuck you! I'll be seeing you in court!" ? Do these people enjoy bending over for those RIAA fat cats?
I mean those guys should learn how to properly erase some data, songs, or whatever. The procedure is rather simple: You remove the hard drive from the central unit, then with the help of a sturdy axe you take it apart. Then collect all of the pieces that resulted from the previous process, put them in a ceramic bowl, add a strong acid and wait.... Let me see them find traces of illegal shit in that one

Ermm, I'm obviously a complete ignoramus and you're probably all going to slap me verbally round the face for this, but what's RIAA? I can guess it's some big corporation... but... what is it?

People who pirate music and movies should go to jail for it.

It's no different from stealing a CD from a store.

In a nutshell, the RIAA is THE Recording Industry. Thus why they're called the Recording Industry Association of America.

They don't necessarily represent everybody, but most of the successful record companies are members of the club. Thus they have a massive amount of money at their disposal, and are extremely powerful in the music business.
