kumquatq3,posted a bit of info on the Winterwind forums that is apparently fresh from the bowels of Interplay:
Iply can no longer sell ANY D&D products (IWD, BG). What is on the shelves is all that is left until a cash dispute with IP/Atari/Vivendi can be worked out. Iply will no longer recieve any cash from Vivendi till this gets worked out. It would seem Iply failed to pay someone on tim, I believe Atari, but I am not sure on details.
I don't think any further comment is necessary.

Also, for those that haven't noticed, the BlackIsle website has been down for a while now.

So what happens? Rights revert back to Atari, what happens to the products? Does Atari then have the ability to sell the backcatalogue or does it go into limbo?

Nope. No one can sell them. Atari owns the brands because they own WotC, who owns the BG/IWD/etc. brands, and also owns D&D.

However, IPLY owns the characters and other things in those games, because BioWare created them under contract to IPLY.

Does this mean I won't be able to buy Dark alliance 2? I was been planning on buying it when it hit the bargain bin.

Herve isn't interested in saving IPLY, he's been using it to fund his other company...

Odin is referring to Titus, the french company Herve Caen is also CEO of. Titus has been in bad shape for a while as well.

Very interesting indeed! Did Herve found Titus? If not, somebody should send the chair an e-mail detailing why herve is such a bad business person. If both his companies are going downhill, there needs to be a corporate reshuffling.

Still don't get that. Is Titus a strawman company or what? I mean it has no real bussiness of its own, it's just leeching of other companies. Imagine a supermarket that closes it's only actual branch and then starts leeching of other supermarket companies to survive. No matter how much money Titus leeches from Interplay, it's not surviving that way, so if the Caens have any sense they'll pull out of that one after Interplay closes.

www.titusgames.com is currently down, too. The server is physically there and pinging back, but the webserver is dead. Maybe it's part of HERVE'S BIG PLAN!

Yeah, just give it a week and you'll see he's got Superman working for him. Superman will spin around the earth, turn back time, finish Jefferson with his superpower so they can release it and make MILLIONS!

Superman is probably still pissed off about what Titus did to him.

Titus is SO good at skullfucking licenses, but only making any money possibly in France and nowhere else?

www.blackisle.com is undergoing website maintenance and is temporarily unavailable.

Website maintenance...right.

just like the forums being gone to "cut costs". jesus. it's like when Herve took over, Interplay went from making and selling games to making and selling a fantasy of itself. after all, it's alot more fun to make up a neat alias and go lie to shareholders than it is to run a business. so why bother? just kick back, feed more talking-points to Shadow Paladin, recruit Elara.

i don't think Herve's great scheme was to ruin Interplay for Titus' benefit. if i remember right, according to orionquest, Herve was swindling -both- companies. he's indeed a crook, but i'm also confident that Interplay's situation is nothing short of Herve's sincere best efforts to run a company. which also explains Titus to me.

Off Topic: Why can't I access duckandcover anymore? Obviously they have closed, but why hasn't NMA reported on this?
