Company strategies vary in this field from case to case. If somebody simply creates a mod for the existing Fallout games, that doesn't sound like a huge threat to Bethesda and their IP.

Now if we talk about a project that actually creates a modern Fallout game on a next generation 3d engine superior to the one featured in Fallout 3 and reuses content that has been aquired by Bethesda AFAIR, this sounds more like a valid threat to their IP to me.

There are usually two kinds of strategies of game companies when you ask for permission to use their IP:
1. They don't reply at all.
2. They so no.

It's rather simple to explain: companies have to defend their IP, if they allow one project to use it, why can't other free of charge projects use it as well?

But this project will use terminologies and ideas (not actual assets) based on the ones appearing on Bethesda's IP, strictly for a non-profitable total conversion mod.
Wouldn't this make the project be considered strictly as a mod rather than a game and will allow the makers sidestep the landmine?
 
You can surely change some game aspects, drop the Fallout reference, rename the SPECIAL acronym and you should be save. However initially the project featured the Fallout reference and the news post still reads that they plan to use SPECIAL as character system.

But it's not a major problem as explained above if they implement the suggested changes.
 
well, if you are say re-creating FO 1/2 in the crysis engine, its not up to beth as they are not holders of those games, IPLY would have to defend them.

if you want to just make a "fallout" themed/styled game in crysis engine with your own story, then yea, you talk to beth.

now if you are just modding the art/style/weapons of crysis into FO leaving original crysis story/plot in order, its not up to beth as its considered "fair use" unless you directly use any art assets of fo 1/2/bos/tac/3.

and of course you cannot sell it. now what you could do is once its done, offer it for dload or you could take i think its up to $3 for shipping a copy on a cd to install your mod, but you couldnt include the original engine unless its gnu engine.

No. Interplay does not hold any rights to re-creations of the concept of Fallout 1/2. Interplay is now allowed to release or give permission to the release of "any new offline content".
