Say IPLY really does go totally down now, and the Fo-license goes to Titus.
If Titus then dies, who has the ownership of the license then? Does it fall to the owner of Titus? Or does it go out for sale automatically?

Under certain circumstances the Fallout license would indeed fall back to Titus. But Interplay has substantial debts all around (including back-rent and back-pay) and they'll have to sell off all their assets, including their licenses, to pay for those.
 
If I did my math right

After multiplying the number of outstanding titus shares by .02 euros then multiplying by .82 (the conversion rate to USD) that is under 1/2 million.

At the last employee meeting (2 weeks ago) Herve was asked what it would take to meet payroll alone.... his answer 3 million, now add in his salary of a 1/2 million plus the rent (which if I know Irvine is probably about 100k per month) and the tax penalties both Fed and State. Not to mention the penalties and fines by the labor commission for late payment of wages, and the outstanding benefits claims and insurance payments due

You do the math, even if Titus is flushed, without a major investor they cannot even meet IP's payroll.

In that case, shouldn't the Fo-license be up for grabs if they fall?

Even as I write this, I'm pretty sure that Vivendi is preparing to unleash their legal hounds in order to start securing Interplay's IPs.

Vivendi advanced a lot of cash to Interplay for the continued distribution of their games in North America. In order to receive this money, Herve made several guarantees to VUG for future products.

"Fifi" would be in default of that contract if Interplay cannot deliver the products that were promised to VUG. This means that Vivendi should have first crack at Interplay's IPs, if he cannot pay back the money.

Didn't anyone wondered why Vivendi hadn't advanced Interplay more money during this troubled time period?

Why keep them alive if you have the first opportunity to pick their corpse. :twisted:

Which makes their situation even more different. They've received a lot of funding/loans from the French government (the French'll give money to anyone), which might've kept them afloat for some time, but will get them in huge trouble in the future, especially with the (albeit limited) funding reforms of France. I might be mistaken, tho'

This is indeed the case with Vivendi. Depending on what happens after Interplay liquifies, they will indeed jump on the corpse quickest. This has been apparent for some time now. Not a dumb move either, that

Yeah, I saw that on GameSpot, was big news everywhere. It doesn't seem to be the only company doing bad.

That's no reason not to go after Interplay, tho'. They'll rip it apart and sell the parts for scrap
 
Hey, isn't BioWare sueing Interplay for a considerable amount of money? What if they get their hands on the Fallout license? A frightening prospect.

Unfortunately, I believe that Bioware would be near the bottom of the barrel in regards to getting the Fallout license.

But, who's to say that whichever company does manage to secure the Fallout license doesn't turn around and approach Bioware about developing Fallout 3.

Even if Bioware is too busy with Jade Empire and Dragon Age, they could farm it out to Obsidian Entertainment.

It would be great to have Chris Avellone use his original Fallout 3 Design Doc. Even better, he can use the Aurora Engine and not have Interplay management looking over his shoulder.

That would be some Karma justice. :D
 
If Vivendi gets the license I wouldn't be too upset, given the recent interviews where they say they are sticking with making PC games. There're also publishers like HD interactive who may make a bid for the license and if they get it I'm pretty certain they'd offer it to Troika or Obsidian, given how they wanted Josh and his team to work on FO3 when they made a previous bid.

Talking of stripping the corpse, maybe they could strip the FRM creation tools for making new critters.... Would sure come in handy
 
I just hope that the license can survive through this chaos.

I still feel sorry for the poor bastards at Interplay who are being left with practically nothing but a huge headache.
 
Why did IPLAY start going downhill? They had some good games, like the baulders gate series and freespace? i dunno. someone explain! ;)

Dammit! First the symbol changes to IPLY.OB.....NOW its IPLYE.OB. Let's face it, no matter how they change the symbol they're still screwed.
