Interplay v Bethesda court filings

I don't consider frymuchan a reliable source of information on IPLY. Too much of it is wishful fulfillment. He's got a long history of stating things as fact when they are not; claiming his opinion is truth. Only believe what you read in court documents.

That being said,
I warned Bethesda, several of us did. Like the movie Ocean's 13, Herve is a less intelligent Willie Banks in that he's cheated on every business deal, and Beth is playing the part of Rhuben - thinking their little scraps of paper were iron clad.

Bethesda was very foolish in cutting that 6 million deal - but hey, I got my money.

And, I stand by my view, that even if Herve won a 200 million power ball lottery, and owned the rights to fallout lock, stock, and barrel, he's still hose it up. He has no game knowledge and his arrogance precludes him from letting others with such knowledge override his decisions.
I am curious to hear about that part. In which way was Bethesda warned about a deal with Interplay? I mean I am not that long around like many others here and even if I know Fallout as game for quite some time my knowledge about the things working behind it are rather small if anything. But to me all in all it seems like for Bethesda it was just more or less a usual affair regarding the IP like how it happens many times either with movies, music or other games (hey Jackson bought for a lot of money the licence to the Beatle songs and made a lot of money no?).

So the question I have is just, what kind of damage or danger would Bethesda had eventualy to face with such a deal, the wrath of Herve maybe ?

I've been around long enough that I've made contacts at several game companies.

Before the ink was dry on the first draft of the Beth deal, a few of us who had friends and contacts at Beth, wrote letters to our friends warning of them of what to expect. I would have rather had Herve forced into involuntary bankruptcy instead of taking Beth's money.

And, as the content of that letter, well, everything we said would came to pass, did.

The smart thing would have been to let Herve fail, cut a deal with Fargo to buy the rights from the post bankruptcy auction, and then produce the game in partnership with Inxile. In my opinion, the game would 1000 times better since Fargo has some of the best people in the industry working for him.

I cant choose who I hate more, Herve of Todd.

Todd. Herve is an idiot who thought he was making a sound financial decision. After all, if POS had done well he'd have probably restarted development on Fallout 3.

Todd knowingly turned FO3 into a bad shooter, and even defended it by saying that it is "Oblivion with Guns, Guns that Shoot Teddy Bears."

Honestly my cycle of hate goes Todd, Chuck, Herve. At least Chuck didn't have the nerve to call his abomination "Fallout 3".

Now, some of us (Hi, Corith) have real reasons to hate Herve, but in the case of Van Buran, I think this is a real issue of never attribute to malevolence what can be attributed to ignorance. Chuck and Todd have no such excuses as they had he fanbase all but BEGGING them not to fuck it up.

After all, if POS had done well he'd have probably restarted development on Fallout 3.

This is a common misconception. Van Buren was canceled before POS was relesed, and work was already started on POS2.

Only if this view through rose-tinted glasses is anywhere near the actual truth, which is pretty unlikely.
I think it's outside the realm of possibility. The author is wrong on so many things that it comes off as sarcasm to me. You can't tell me that this isn't a joke:

I'M FEELING VERY GOOD ABOUT INTERPLAY'S POSITION ON THIS AND I LOOK FORWARD TO BETHESDA GETTING SOME VERY, VERY NEGATIVE PRESS FROM NMA AND OTHER SITES WHEN THEY LEARN ABOUT HOW BETHESDA TRIED TO MESS WITH INTERPLAY EVERY STEP OF THE WAY, EVEN TRYING TO STOP THE GAMETAP DEAL FROM GOING THROUGH. Bad, Bad, Bethesda, your greed will be your undoing. NMA and other fallout sites are very very powerful and have lots of members that can boycott and otherwise hit you right back.

Wouldn't it be nice if this case would lead to mutual assured destruction?

Both Herve Caen's Interplay and Zenimax Bethesda being wiped out of existence.

And then Brian Fargo swoops into the courtroom wearing a superman costume and saves the fallout franchise like so many damsels in distress.
