Corith, put a lien against everything of his you can think of, including the car. :D The amount owed is over $10k in just your case, so therefore it nicely falls outside of small claims laws for considerations in filing liens (in most states, I have heard in Cali and others it may be $5k, so it doesn't matter - Herve is hosed), so have fun. Invite multiple people into it, and see how quickly you can freeze the slimy frog's assets, which may be possible if it is judged to be severe enough. With the risk of a liquidate and run CEO, and if this is brought to the judge's attention, it spells SCREWED.

Seems he doesn't like some of things being said about him. Boo-hoo. Does that mean he is going to take everybody on this board to court, or on raging bull, how about the French boards where they are even meaner (as if that was even possible). The man must really love spending time in court rooms, because with the number of cases he must live there, and he now it seems he only wants more.

BTW: His offer was the random amount of $4,690.41, not the $16,765.54 which in includes $7,869.36 in court awarded penalties and interest. I can't even begin to imagine where he is getting the $4,690.41 number. Both the labor board and I show that as of June 15th, 2004, the real amount at the time of Separation is $11,344.04 (including unpaid vacation totaling $3,970.40).

It also seems he can't read. The judgment paper work that arrived from the court clearly states he has a maximum of 15 days in which to appeal. It has been 20. I wonder what he is going to use has his basis for appeal, he just doesn't wanna pay?

The man is truly a fool with no clue (There you go Herve, I'm ready for my court summons).

Herve, you may not remember me but I was a shareholder in IPLY so while not as incensed as the employees you screwed I still think you look like a cross between a poodle of questionable sexual orientation and a sewer rat.

I cant belive the poor bloody employees are still going thru this! Is this guy insane?(Herve). At least by the sounds of it he's either going to have to pay up now, or forefit assests until they cover the costs lol. And let that be a lession to all who with to run a business! PAY YOUR STAFF.

my statement was to the fact that herve would have to prove that the comments against IPLY, black isle, and management are not true and thusly libelous remarks. if they are true then they are not libelous remarks and thus not illegal to say. but the burden of proof would have to be on herve and i believe libel is a civil statute.
 
As of 10/12/2005 a Entry of Judgment was filed in the Superior Court of California, County of Orange for Mr. Cean's refusal to pay, after over 18 months, the accrued but unspent vacation hours plus the last 3 pay periods of wages for at least 3 employees, if not more.

Herve's attempted bluff that an appeal had been filed in order to force me to allow him not pay the court awarded penalties and interest has failed.

Now, I just need to collect. Anybody have any suggestions?
